Restrictions and obligations of migrants living in the Russian Federation on a residence permit

In addition to numerous rights, obtaining a residence permit in the Russian Federation imposes foreign citizen also some responsibilities. These include:

  • observance of the Constitution of the Russian Federation and current legislation;

Conditions for obtaining a residence permit

  • renunciation of citizenship of the Russian Federation for one reason or another and its termination in the past;
  • the presence of a guardian or assistant with a valid citizenship of the Russian Federation or an open residence permit for incompetent foreigners;
  • the presence of one of the parents with citizenship or a residence permit of the Russian Federation for minor children born in Russia or having a temporary residence permit.

Within the framework of international agreements, citizens of Turkmenistan and Belarus, as well as stateless persons who came to the Russian Federation from Turkmenistan, can apply for a residence permit under a simplified system: without obtaining a temporary residence permit and living in Russia for more than a year.


The procedure for obtaining a residence permit by foreign citizens

The procedure for obtaining a residence permit in Russia, as a rule, takes a long time if the migrant does not have grounds for obtaining it in a simplified manner. However, strict compliance with the requirements of the migration service can significantly speed up the process and cause almost no difficulties.

The general procedure for obtaining a residence permit in the Russian Federation includes three stages:

  1. Registration of a temporary residence permit and legal stay in the country for more than 12 months.
  2. Collection and execution of a package of personal documents.

Terms of consideration of an application for a residence permit in the migration service

The protocol of the territorial bodies of the Main Department of Internal Affairs of the Ministry of Internal Affairs establishes various periods for processing applications for issuing a residence permit to foreign citizens. Maximum term consideration of an application for a residence permit after the submission of documents is 6 months.

Special cases:

  • applications of citizens of Belarus and Turkmenistan, as well as highly qualified specialists and members of their families are processed within 3 months;

Documents for obtaining a residence permit in Russia

Obtaining a residence permit in the Russian Federation involves submitting to the migration service of the selected territorial district a complete package of documents provided for by the regulations. All of them must be legally correct. Papers received abroad and issued in a foreign language must be translated into Russian. Copies of originals and translations must be notarized without fail.

The list of documents for a residence permit includes:

  • application for a residence permit in 2 copies - is a questionnaire form, which can be filled in using computer tools or by hand;
  • 4 black and white or color photographs of the applicant sized 35×45 mm (2 photographs for stateless persons);
  • identity document with a TRP mark - national or international passport– for foreign citizens or temporary residence permit – for stateless persons;
  • a document confirming the existence of an official source of income in excess of the subsistence minimum established in the Russian Federation, or a paper confirming the migrant's incapacity for work (certificate from the place of work, bank account statement, form 2NDFL, pensioner's ID and etc.);

Renewal of residence permit

A residence permit is valid for up to 5 years, and its term, unlike a temporary residence permit, can be extended an unlimited number of times. Extension of a residence permit in Russia is carried out upon a personal application of a foreign citizen. An application should be submitted to the territorial body of the Main Department of Internal Affairs of the Ministry of Internal Affairs at the place of residence of the migrant or at the place where the residence permit was issued.

It is necessary to apply for an extension of a residence permit no later than 2 months before its expiration date.

List of documents for the extension of a residence permit:

  • 1 copy of the application for the extension of the residence permit;
  • 4 photos of the applicant's face in full face in color or black and white - for citizens of other countries, 2 photos - for stateless persons;
  • a valid residence permit;
  • foreign or national passport, or other document proving the identity of the applicant.

The extension of a residence permit issued to a highly qualified specialist and his family members is carried out taking into account the validity period of the current or newly obtained work permit by the migrant.

The duration of consideration of an application for an extension of a residence permit is no more than 60 days from the date of its submission.

According to the general rule established by paragraph 3 of Art. 8 of Law No. 115-FZ, a residence permit of the Russian Federation is valid for 5 years. Participants in the compatriots' resettlement program receive it for the duration of the program participant's certificate.

What documents are required to obtain a residence permit

The list of documents that must be submitted to the territorial office of the GUVM in order to obtain a residence permit can be formed on the basis of paragraphs 28 - 47 of the Regulations.

It includes:

  • 4 identical color or black and white photographs of the applicant, 2 of which are glued to the application. To obtain a residence permit for a stateless person (stateless person), 2 photographs are sufficient;
  • foreigner's passport or other identity document recognized as such in accordance with international agreements. Stateless persons may provide another document, such as a residence permit in other countries;
  • receipt of payment of the state fee for the issuance of a residence permit;
  • a document confirming the availability of means of subsistence not lower than the amount of the subsistence minimum monthly, or confirmation of incapacity for work;
  • confirmation of the availability of accommodation. It does not have to be the right of ownership, it is enough to register at the place of residence, at least temporarily. Therefore, the answer to the question of whether it is possible to obtain a residence permit without a residence permit is unambiguously negative. Not possible under any circumstances;
  • a document on passing a medical examination (certificate of the state of health of a foreigner);
  • certificate of absence of HIV infection;
  • for knowledge of the Russian language, history and fundamentals of the legislation of the Russian Federation, or a document confirming the right to do without passing the exam;
  • a statement of renunciation of citizenship or the impossibility of such a renunciation, if the international agreements of the Russian Federation do not provide for the possibility of retaining it.

What additional documents may be required to obtain a residence permit

Depending on the grounds on which a stateless person or a foreigner applies for a residence permit, additional documents may be required.

For minors and migrants with limited legal capacity, in addition to other documents listed above, you will need:

  • two copies of the application, drawn up in the form of Appendix No. 2 to the Regulations (instead of the application according to Appendix No. 1);
  • birth certificate, if documents are submitted by parents or adoptive parents;
  • document on disability, if any;
  • documents confirming the status of legal representatives.

Documents for a residence permit for native speakers of the Russian language, refugees, participants in the resettlement program, highly qualified specialists

Persons applying for a residence permit in a simplified manner, bypassing the requirements of paragraphs 1-3 of Art. 8 of Law No. 115-FZ, they must document that they have grounds for this, providing a choice of:

  • decision on recognition as a native speaker of the Russian language;
  • confirmation of the status of a highly qualified specialist;
  • confirmation of vocation by a refugee;
  • certificate of participant in the program of resettlement of compatriots.

In addition, you will also need an application and photographs (2 pieces). For highly qualified specialists, you will also need an employment contract.

Refugees can apply for Russian citizenship without a residence permit.

Russian language exam: who should take it

For several years now, since 2015, the majority of migrants wishing to obtain a residence permit in the Russian Federation must confirm their knowledge of the Russian language, history, and fundamentals of the country's legislation. Thus, foreigners and stateless persons are selected who are able to quickly integrate into Russian society and find employment.

Art. 15.1 of Law No. 115-FZ provides that it is not necessary to take the exam for:

  • holders of diplomas or certificates confirming the receipt of education in institutions of the USSR before September 1, 1991;
  • persons who have a diploma or certificate confirming the receipt of education in Russian secondary and higher educational institutions from September 1, 1991;
  • persons under the age of 18;
  • incapacitated or disabled migrants;
  • men over the age of 65;
  • women over 60;
  • highly qualified foreign specialists;
  • persons recognized as native speakers of the Russian language;
  • citizens of the Republic of Belarus;
  • participants of the program of voluntary resettlement of compatriots and members of their families.

The list is closed, and therefore all other foreigners who wish to obtain a residence permit, as well as a temporary residence permit, patent or citizenship, must be tested.

How is the test for knowledge of the Russian language, history and fundamentals of legislation to obtain a residence permit

Already in 2015, testing centers were established on the basis of the country's largest higher educational institutions. The first of these appeared in State Institute Russian language them. A.S.   • reading in Russian and understanding both household and business information contained in the text;
  • understanding of household and business information expressed in Russian by ear;
  • filling in the simplest business documentation: questionnaires, forms and notices;
  • the ability to build a coherent monologue and dialogue in Russian;
  • knowledge of important facts of Russian history;
  • knowledge of the main historically significant figures;
  • knowledge of the main cultural and religious traditions;
  • basic knowledge constitutional order country;

  • knowledge of the rules of interaction with authorities in the Russian Federation;
  • knowledge of the rules of interaction with consular authorities;

Medical examination for obtaining a residence permit

Despite the fact that when obtaining a temporary residence permit, migrants undergo a medical examination, if they wish to obtain a residence permit in the Russian Federation, they will have to provide new data on the state of health, namely:

  • certificate that the applicant is not a carrier of HIV infection;
  • health certificate of a foreigner.

To obtain them, you will have to not only pass an HIV test, but also visit some specialists:

  • addiction psychiatrist,
  • phthisiatrician,
  • dermatovenereologist,
  • therapist.

During the examination, the following will be carried out:

  • conversation with a psychiatrist;
  • urinalysis for drug use and psychotropic substances in the recent past;
  • blood test for HIV;
  • blood test for syphilis;
  • fluorography.

If, following the results of the examination, a migrant is found to have diseases included in the list approved by Decree of the Government of the Russian Federation of April 2, 2003 No. 188, he will not only not be able to obtain a residence permit, but will also be sent for treatment to specialized institutions.

Only accredited institutions licensed to conduct such activities can conduct a medical examination and issue relevant certificates and conclusions. Which institutions can provide such services in each particular region should be clarified directly in the territorial division of the Main Department of Internal Affairs of the Ministry of Internal Affairs, or on the official website of such offices.

Usually, the examination is carried out within 1 day, and the term for issuing a certificate does not exceed a week, but if you wish, you can speed up the resolution of the issue up to 3 days for an additional fee.

The validity period of the certificates is indicated on them, usually it is 3 months.

What are the costs of acquiring a residence permit. State duty

The cost of a residence permit in the Russian Federation consists of several components:

  • state duty for issuing a residence permit;
  • expenses for compulsory Russian language testing for migrants who are not native speakers and do not belong to other preferential categories for which the exam is not provided.
  • medical examination costs.

The amount of the state duty is determined by paragraph 18 of Part 1 of Art. 333.28 of the Tax Code of the Russian Federation and amounts to 3500 rubles.

In case of refusal to issue a residence permit to a foreign citizen in the Russian Federation, the money spent on paying the state fee will not be returned. If the applicant paid the fee, but for some reason abandoned the idea of ​​applying for a residence permit of the Russian Federation, then he can apply to the territorial office of the Main Department of Internal Affairs of the Russian Federation in order to write an application for a refund.

The validity period of the receipt must be calculated according to paragraphs. 3 and 6 Art. 333.40 of the Tax Code of the Russian Federation. This norm determined that within 3 years it is possible to return the funds of the overpaid state fee. During this time, you can either apply for a residence permit documents, or receive funds back. Payment can be made at branches of Sberbank of the Russian Federation. You can also use the services of a mobile operator or payment terminals, but the commission can reach 7-10%.

Exam cost

Testing for knowledge of the Russian language, history and fundamentals of Russian law is carried out on a commercial basis. This means that its payment is fully assigned to the migrant. Its cost varies depending on which center will be tested and is approximately 5200 - 5800 rubles.

Many centers offer discounts for students of Russian universities and migrants from the DNR and LNR. Usually, the payment is reduced to 2 times.

If the exam is passed on the first attempt, then the costs for this item will end.

If you do not get sufficient results the first time, you will have to pay for a retake. Here, the costs will depend on what exactly and in what quantity was failed. The options are:

  • if any one module is failed, then you will have to pay approximately 30% of the cost of the exam - about 1800 rubles;
  • if 2 modules are failed, one of which is in the Russian language, then the retake will cost 40 - 50% of the base cost of the exam - about 2500 r;

The cost of a medical examination

When obtaining a residence permit, the item of expenses for a medical examination will not be the smallest. Only specially accredited organizations can conduct a medical examination and issue a health certificate based on its results. medical institutions. Despite the presence of a compulsory medical insurance policy for the majority of persons applying for a residence permit (since they had previously issued a temporary residence permit), they have to spend money on passing the inspection. The fact is that such examinations are not included in the list of services provided for by the compulsory insurance policy.

On average, an examination for a residence permit will cost 3500 rubles. However, this amount may increase if the applicant needs to obtain the right urgently. What are the conditions for issuing a residence permit and can they refuse to issue

    confirmation of receipt of alimony;

    certificate of income of the person who is dependent on the applicant;

    certificate of availability of a bank deposit indicating the account number and the amount of the deposit;

    another document confirming the receipt of income from activities not prohibited by law or disability.

At the same time, it must be borne in mind that a bank deposit must confirm that a foreign citizen has funds in the amount not lower than the subsistence minimum for the period of provision of the public service. The subsistence minimum established by the law of the constituent entity of the Russian Federation, on the territory of which a foreign citizen applies for a residence permit, is taken into account.

5. Document confirming the existence of ownership(or other right) to a dwelling.

This document is submitted by a foreign citizen who submits an application after 3 years from the date of entry into Russia.

6. Documents confirming that this foreign citizen does not have drug addiction and infectious diseases that pose a danger to others.

7. Certificate confirming that the applicant does not have a disease caused by the human immunodeficiency virus(HIV infections).

This document may not be submitted by a foreign citizen suffering from a disease caused by the human immunodeficiency virus (HIV). This is permissible if the specified foreign citizen has family members (spouse (wife), children (including adopted children), parents (including adoptive parents) - citizens of the Russian Federation or foreign citizens permanently residing in the territory of the Russian Federation. The applicant confirms the presence of the above family member and the fact of his permanent residence in the territory of Russia with the relevant documents.

    marriage certificate;

    birth certificate;

    documents confirming the fact of adoption (adoption);

    internal passport of a citizen of the Russian Federation with a mark of registration at the place of residence in R;,

    residence permit of a foreign citizen in the Russian Federation.

Copies of these documents are attached to the application.

8. A document that confirms the foreign citizen or stateless person's knowledge of the Russian language, knowledge of the history of Russia and the fundamentals of the legislation of the Russian Federation.

Such documents are:

    certificate of proficiency in Russian, knowledge of the history of Russia and the fundamentals of the legislation of the Russian Federation;

    a state-recognised document on education (at a level not lower than the basic general education) issued educational institution on the territory of a state that was part of the USSR, until September 1, 1991;

    a document on education and (or) qualifications issued to persons who have successfully passed the state final certification on the territory of the Russian Federation since September 1, 1991.

The above documents are not submitted by the following categories of applicants:

    men who have reached the age of sixty-five;

    women who have reached the age of sixty;

    participants of the State Program and their family members;

    foreign citizens recognized as native speakers of the Russian language;

    foreign citizens who are citizens of the Union State formed Russian Federation and the Republic of Belarus;

    highly qualified specialists and their family members;

    who applied for a residence permit on the grounds that they have a parent, adoptive parent, guardian, trustee, son or daughter, who are Russian citizens and permanently residing in our country.

On his own initiative, the applicant may submit the following documents:

    a receipt for payment of the state duty, the amount of which is currently 5,000 rubles;

    a copy of the income declaration (if this document confirms that the applicant has a legal source of livelihood);

    a document confirming the existence of a dwelling.

If the applicant fails to submit these documents, the officials of the migration unit must independently verify the necessary information (paragraph 49 of the above Regulations).

In the absence of any documents (out of the three listed above), officials do not have the right to refuse to accept documents.

The need to submit notarized copies of documents

When submitting documents for issuing a residence permit, the applicant will need the following copies of documents certified by a notary, confirming the following circumstances:

    the presence of family relations;

    knowledge of the Russian language, knowledge of the history of Russia and the basics of Russian legislation;

    having a legitimate source of livelihood;

    the availability of the applicant (if necessary) living quarters.

In addition to the above documents, it is also necessary to submit a notarized copy of the document proving the identity and citizenship of the applicant.

All copies must be duly executed and submitted to the migration unit along with the rest of the documents on the day of applying for a residence permit.

A permanent residence permit in Russia for 2016 opens up the possibility for a foreigner to permanently reside in any of the selected regions of the country. To submit questionnaires and applications with the subsequent receipt of a residence permit in Russia, it is necessary to prepare a list of documents. This includes:

  • passport of international importance (translated by a notary), internal passport (for citizens of the CIS);

Step 1: collecting documents

To obtain a residence permit, a foreign citizen provides his passport and RVP in Russia. RVP registration is indicated in the passport through a stamp. Submission of an international document for identification requires translation in a notary's office and certification. Such a service is provided in any bureau where documents of international importance are translated.

After that, the applicant must take photographs and attach them to the rest of the certificates. Step 2: 2-NDFL certificate

Step 3: physical examination
