How the legislator regulates the preparation of a tender application

Tenders are held in different forms: auction, competition or other. There are also separate rules governing various types of trading. For example, Art. 46.3 of the Urban Planning Code of the Russian Federation determines the holding of auctions for the conclusion of contracts for the development of the built-up area.

Regarding the answer to the question of how to apply for a tender, how the source general order we can mention the law "On the contractual system in the field of procurement of goods, works, services to meet state and municipal needs" dated 05.04.2013 No. 44-FZ (hereinafter - Law No. 44-FZ). How to submit a package of documents for a tender

The tender documentation prepared by the customer describes in detail, how to make an application for a tender right. An application is a designation of the application for participation in the auction itself and the package of documents attached to it (the so-called volume). If the tender is held in the usual manner, then the submitted package includes:

It is advisable to indicate the name of the participant and his contact details on the envelope, although the absence of such information is not a reason for refusing to accept the application.

Submitting an application electronically

An application for participation in the tender can be submitted in electronic form, if such an opportunity is allowed by the tender documentation. In this case, the application form and the documents attached to it are sent with closed access (that is, it is impossible to study them before the start of the verification of applications).

  1. Only a person accredited on a specific electronic platform can participate in the tender.
  2. The application itself consists of 2 parts:
    • in the first part, the participant discloses his offer, describes it and indicates the conditions;
    • in the second, the same information is given as in a regular application.

Regardless of the form of the tender, the application for participation must contain the following information and documents (Article 51 of Law No. 44-FZ):

  • the name of the organization, all known and available addresses, as well as contact numbers, information about the founders;
  • for individual entrepreneurs - passport data;
  • an extract from the Unified State Register of Legal Entities and EGRIP or their notarized copy not older than 6 months;
  • decision on the election or order on the appointment of the head of the enterprise;
  • if a representative is engaged in the tender - a power of attorney or its notarized copy;
  • additional documents if the organizer has special requirements (for example, the tender requires a license or membership in any self-regulatory organization);
  • copies of constituent documents;
  • proposal of the tenderer in terms of price, quality, timing, etc.

Approximate order of actions

  2. Constituent documents : current edition of the charter, decision of the sole participant, etc.
  3. Other documents confirming legal capacity : extract from the Unified State Register of Legal Entities, sheets of entry into the Unified State Register of Legal Entities, certificates of the Primary State Registration Number and TIN, etc.
  4. Accounting documents : reporting for the last reporting period, tax returns, calculations of insurance premiums, etc.

When the lists are ready, divide all documents into four groups:

  1. "There are ready-made" (for example, many people have copies of constituent documents or financial statements on hand, as they are often required for their current work);
  2. "We must do it ourselves" (for example, you yourself will need to fill out certificates according to the customer's form);
  3. "We need to make copies" (for example, there are existing or completed contracts, but they need to be copied);
  4. "It is necessary to request" (for example, you will have to request a fresh extract from the Unified State Register of Legal Entities or letters of guarantee from suppliers).

Pay attention to the requirements for filling out the commercial proposal, which are indicated in the documentation. It is very important to observe the use of monetary units: usually tenders are held in rubles, therefore the commercial proposal must also be drawn up in rubles, even if there are import items in the list of products that you purchase for currency. Applications can be added to the CP. Participant information

As part of the tender application, a potential supplier must provide all the necessary information about himself. In principle, this information is pretty standard. Usually you need to fill out a questionnaire with basic information about yourself, provide information about the owners, about the volume of supplies to last years, the availability of ongoing and completed litigation, the availability of the necessary human resources and production capacity. All this information is most often included in the application in the form of certificates according to the customer's form, which are attached to the tender documentation.

How to fill out such certificates? Here are some tips:

indicate current and truthful information in the questionnaire : carefully check the legal and postal addresses, telephones, e-mail addresses - errors will lead to the fact that the customer will not be able to contact you;

fill out the documents as fully as possible : if the customer form provides for the disclosure of the volume of supplies for the last three years, then it is necessary to provide data for exactly three years, not two or one. The more fully your documents in the application are filled in, the more points the competition commission can give you;

it is not necessary to disclose information constituting a trade secret ... If you consider any information a commercial secret and do not want to show it to the customer, then you can not provide it, but include an explanation of such a decision in the application. For example, you can consider the same supply volumes over the past three years as a trade secret. In this case, you can attach an official letter stating that this information is confidential instead of a certificate according to the customer's form. Another way out of this situation may be this option: you fill in the supply volumes not in value terms (rubles), but in physical terms (tons, kg, pieces), and also attach a letter where you explain such a presentation of the form;

Documents of title

The documents of title include constituent documents, an extract from the Unified State Register of Legal Entities, sheets of entry in the Unified State Register of Legal Entities and TIN, financial statements. Copies of these documents must be present in the application. Pay attention to their completeness and relevance. For example, the charter must be valid ( latest revision), - fresh, received in the last month, etc. If any changes have occurred since the registration of the company, then they must be confirmed with copies of decisions, sheets of records in the Unified State Register of Legal Entities and certificates of amendments.

The financial statements are at least provided for the previous year and the last reporting period of the current year. Individual entrepreneurs, instead of reporting, can attach copies of declarations to the application. Documents confirming the possibility of delivery

These documents include:

  • copies of existing contracts;
  • copies of dealer / distribution agreements;
  • letters of guarantee from your suppliers.

It is important to consider the following points here.

The preference is always given to the participant who is the manufacturer of the declared products. As a rule, it is the manufacturer who can offer the customer the lowest price. The second "in rank" are official representatives / dealers / distributors who work directly with domestic or foreign manufacturers. The third place in this list is occupied by participants who can be classified simply as "suppliers", that is, in fact, resellers. Such suppliers most often participate in tenders where lots are mixed, that is, they contain positions from different manufacturers - one manufacturer will in no way be able to cover the customer's need for products that it does not produce. A reseller can: he buys goods from several companies and delivers them to the customer.

The documents confirming the possibility of delivery are ranked in the same way. The greatest weight will have valid contracts and letters of guarantee from manufacturers and authorized dealers.

When all documents are collected, each of them is signed by the head, and copies are certified, if necessary, the application can be scanned and uploaded to the ETP. Requirements for scans of documents, their formats and names are prescribed in the application. If the application is submitted in paper form, then the collected package of documents is drawn up in an envelope and sent to the customer's address. If you plan to take part in an electronic auction or other electronic tenders, we recommend that you additionally familiarize yourself with Article 66 of Law 44-FZ, since an application for participation in an electronic auction consists of two parts, and it has more stringent requirements than other applications for participation in the tender.

What information should be in the tender application

As already mentioned, one of the main tasks of the tender application is to provide accurate and complete information about the company and the supplied goods, so that the customer can decide whether this participant meets all the requirements for potential suppliers. That is why, when submitting an application, they must contain both information about the supplier himself and information about the supplied product (service).

In the application for participation in the tender, it is necessary to indicate:

  • ✔ Consent to supply goods, perform work or provide services on the terms stipulated in the tender documents. Without this consent, the company will not be admitted to bidding;
  • ✔ The exact name of the supplied product (service);
  • ✔ Specific technical characteristics of the product, which is supposed to participate in tenders;
  • ✔ The number of supplied goods (volume of work performed, services provided);
  • ✔ Documents that confirm the compliance of the goods with all the necessary quality requirements, as well as the requirements provided for by customers in the tender documents.

In the part of the applications where the product is described, special attention must be paid to its quality and technical characteristics. All declared parameters must comply with industry regulations and customer requirements.

In the event that the technical characteristics of the goods do not match, the tender will be rejected. Compliance must be 100%. In addition to information about the product, when submitting applications, the participant must indicate information about himself.

Information about the participating company, which should be in the application for tender:

  • ✔ Company name, company name, if any;
  • ✔ Contact phone number of the company;
  • ✔ Postal address (registration and actual location);
  • ✔ TIN;
  • ✔ Decision on the election and order on the appointment of a manager or an authorized person;
  • ✔ Copies of constituent documents;
  • ✔ Extract from the Unified State Register of Legal Entities or Unified State Register of Legal Entities;
  • ✔ The proposal of the participant, which he makes to participate in a specific auction;
  • ✔ Additional documents, if required by law or by the customer.

The exact list of documents and information, as a rule, must be specified in the tender documents - you must carefully read it. If tenders are held in the form of an electronic auction, then the application consists of two parts: the first one gives consent to participate in the auction and indicates the characteristics of the goods, and the second contains additional information about the company. Parts of applications are considered separately at different stages of the auction.

As a rule, customers additionally draw up instructions for filling out applications, which are placed in the tender documents. This is done in order to facilitate the bidding process and to avoid ridiculous mistakes.

What is the deadline for submitting an application for participation in the tender

The proposal is essentially the main proposal, especially when it comes to traditional rather than electronic tenders. The main task of the supplier in this case is to describe his offer as accurately as possible, to show the advantages and convey all the important information, on the basis of which the customer will make a choice in the future. The quality and completeness of the information in the application is a guarantee that the participant's proposal will be considered, and, in the case of auctions, the participant will be admitted to the second stage of participation in tenders.

It is important to remember that the customer sets the deadline for submitting applications for each tender, they must be strictly observed, since the application arriving later than the deadline will simply not be taken into account. This is especially true for applications that are sent using mail.
